Terms of Service
These Terms of Service govern your access to and use of Aethor, including the Aethor Discord application, the website aethor.eu, the Aethor dashboard and any related services provided by us.
1. Service Provider

“Aethor” is the name of the software project and Discord application. Aethor is not a separate legal entity.
2. Definitions
For the purposes of these Terms:
- “Aethor” means the Aethor Discord application, website, dashboard, API and related services operated by us.
- “User” means any person who directly interacts with or uses Aethor.
- “Server” means a Discord server or community in which Aethor has been installed.
- “Server Administrator” means a person authorised to install, configure or manage Aethor within a Discord server.
- “Content” means messages, files, configuration, text, images, attachments, commands, ticket content and other information processed through Aethor.
- “Discord” means the Discord platform and related services operated by Discord and its respective affiliates.
3. Scope and Acceptance of These Terms
These Terms apply to the use of Aethor and its related services.
Where you install Aethor in a Discord server, you confirm that you are authorised to do so and that you have had the opportunity to review these Terms before installation or configuration.
Where a separate individual agreement exists between you and us, that individual agreement takes precedence over these Terms to the extent of any conflict.
Mandatory statutory rights, particularly those applicable to consumers, remain unaffected.
4. Eligibility
You may use Aethor only if you are legally permitted to use Discord and the relevant digital services under applicable law.
You must comply with any applicable age requirements imposed by Discord.
If you use Aethor on behalf of a company, organisation or other legal entity, you confirm that you have sufficient authority to act on its behalf.
5. Relationship With Discord
Aethor is an independent third-party application designed to interact with Discord.
Aethor is not affiliated with, sponsored by, endorsed by or operated by Discord Inc. unless explicitly stated otherwise.
Your use of Discord remains subject to Discord's own terms, policies, community guidelines and developer platform rules.
Discord may change, restrict or discontinue API functionality at any time. Such changes may affect the availability or functionality of Aethor.
6. Description of the Service
Aethor provides tools for managing and operating Discord communities. Available functionality may include, among other things:
- moderation tools;
- automated moderation;
- server event logging;
- warning and moderation case systems;
- ticket systems;
- ModMail;
- anti-spam and anti-raid functionality;
- security and abuse-prevention functionality;
- server configuration tools;
- web dashboard functionality;
- Discord OAuth authentication;
- notifications and integrations;
- other community-management functionality introduced over time.
The exact functionality available may depend on Discord permissions, server configuration, application permissions, API availability, technical limitations and the features enabled by the relevant Server Administrator.
7. Server Administrator Responsibilities
Server Administrators are responsible for configuring Aethor in a lawful and appropriate manner.
In particular, Server Administrators are responsible for:
- ensuring that they have authority to install and configure Aethor;
- selecting appropriate Discord permissions for Aethor;
- configuring moderation and logging functionality appropriately;
- informing members about relevant server rules and monitoring where required by applicable law;
- reviewing moderation settings and automated actions;
- ensuring that server-specific use of Aethor complies with applicable laws and Discord policies.
8. Discord Permissions
Certain Aethor functionality requires Discord permissions.
By granting permissions to Aethor, a Server Administrator authorises Aethor to use those permissions only insofar as necessary to provide the enabled functionality.
Aethor should not be granted permissions that are unnecessary for the functions a server intends to use.
We may update recommended permissions when functionality or Discord requirements change.
9. Automated Moderation
Aethor may provide automated moderation systems capable of analysing messages, server activity or technical indicators based on rules configured by Server Administrators.
Automated actions may include:
- deleting messages;
- creating warnings;
- creating moderation cases;
- temporarily restricting users;
- notifying moderators;
- performing other configured moderation actions permitted by Discord.
Automated moderation cannot guarantee perfect detection and may produce false positives or fail to detect certain behaviour.
Server Administrators should therefore configure moderation rules proportionately and review automated decisions where appropriate.
Nothing in Aethor is intended to constitute an automated decision producing legal effects or similarly significant legal consequences for an individual.
10. Logging
Aethor may provide configurable logging functionality for Discord server events.
Depending on configuration, this may include moderation actions, member events, edited or deleted messages, role changes, channel changes, voice-state metadata and other Discord events.
Server Administrators are responsible for deciding which logging features are appropriate for their community.
Ordinary voice logging refers to technical state information such as entering or leaving a voice channel. Aethor does not record the audio content of Discord voice conversations unless a separate, explicitly disclosed feature with the necessary legal basis is introduced.
11. Tickets, ModMail and User Communications
Users may communicate with server staff through features such as tickets, ModMail or support systems.
You are responsible for the information you submit through these systems.
You must not knowingly submit:
- passwords;
- authentication tokens;
- payment card credentials;
- malware;
- unlawfully obtained personal data;
- content whose disclosure would violate applicable law.
12. Acceptable Use
You may not use Aethor to engage in unlawful, abusive or harmful activities.
In particular, you may not:
- use Aethor to violate applicable laws or regulations;
- use Aethor in violation of Discord's Terms of Service, Community Guidelines or Developer Platform rules;
- harass, threaten or unlawfully target another person;
- distribute malware, phishing links or malicious software;
- attempt to steal authentication tokens or credentials;
- attempt to bypass security, permission or rate-limit mechanisms;
- intentionally overload, disrupt or degrade Aethor's infrastructure;
- probe or exploit vulnerabilities without prior authorisation;
- impersonate Aethor, its operator or another person in a misleading manner;
- reverse engineer protected components where such restriction is legally permissible;
- use Aethor to collect personal data for unlawful surveillance, profiling or harassment;
- use automated tools to abuse Aethor's commands, APIs or infrastructure.
13. Security Research
If you discover a potential security vulnerability affecting Aethor, please report it privately using the contact details provided below.
You must not intentionally access, alter, destroy or disclose data belonging to other users while investigating a vulnerability.
Public disclosure should not occur before we have had a reasonable opportunity to investigate and address the issue.
14. User Content
You retain the rights you already hold in content submitted by you.
By submitting content through Aethor, you grant us a limited, non-exclusive right to process that content only to the extent necessary to:
- provide the requested functionality;
- transmit content to intended recipients;
- store information where necessary for the feature;
- protect the service against abuse;
- comply with applicable legal obligations.
This permission ends when the relevant content is deleted and no lawful reason for continued retention remains.
15. Intellectual Property
Unless otherwise stated, Aethor's original software, branding, design, text, graphics, logos and other original materials are protected by applicable copyright and intellectual property laws.
These Terms do not transfer ownership of Aethor or its intellectual property to users.
Third-party trademarks, software, libraries, names and logos remain the property of their respective rights holders.
16. Third-Party Services
Aethor relies on or may integrate with third-party services, including Discord, hosting providers, infrastructure services and other integrations.
Third-party services are governed by their own terms and policies.
We are not responsible for third-party services beyond our own legal responsibilities and cannot guarantee their uninterrupted availability.
17. Free Features
Certain Aethor features may be provided free of charge.
The availability, scope and functionality of free features may be changed where there is a valid reason, including:
- security requirements;
- Discord API changes;
- technical improvements;
- legal requirements;
- prevention of abuse;
- changes in infrastructure requirements.
Mandatory statutory rights remain unaffected.
18. Paid Features
If Aethor offers paid features, subscriptions or other paid digital services, the price, billing period and included functionality will be displayed before the user places an order.
Additional product-specific conditions displayed during checkout become part of the contract.
Paid features will not be charged unless the user has completed the relevant ordering process.
If Aethor currently offers no paid services, this Section does not create any payment obligation.
19. Contract Formation for Paid Services
Where paid services are offered, presentation of a product or plan on the website does not necessarily constitute a binding contractual offer unless expressly stated otherwise.
The user submits an offer to enter into a contract by completing the order process and activating the clearly labelled final order button.
A contract is concluded when we expressly accept the order, provide confirmation of the contract or activate the purchased service.
20. Prices and Payment
Prices applicable to paid services are displayed before purchase.
Where applicable, payment is processed through the payment provider identified during checkout.
Users must provide accurate payment information to the respective payment provider.
Statutory tax and invoicing requirements apply.
21. Subscriptions
If Aethor offers recurring subscriptions, the billing interval, price, renewal conditions and cancellation options will be displayed before the subscription is concluded.
A subscription will renew automatically only where automatic renewal has been validly agreed.
Consumers retain all mandatory statutory cancellation and termination rights.
Where legally required, an online cancellation function will be provided for eligible recurring consumer contracts.
22. Consumer Right of Withdrawal
Consumers may have a statutory right of withdrawal for distance contracts.
Where a statutory right of withdrawal applies, the legally required withdrawal information and model withdrawal form will be provided separately before or when the contract is concluded.
These Terms do not replace any legally required withdrawal instructions.
Where a consumer expressly requests that a paid service begin before expiry of the withdrawal period, the legal consequences of that request will be governed by applicable law and by the withdrawal information provided at checkout.
Where legally required for contracts concluded through an online interface, Aethor will provide an electronic withdrawal function.
23. Refunds
Statutory refund rights remain unaffected.
Any additional voluntary refund policy offered by Aethor will be described separately and does not restrict mandatory consumer rights.
No provision in these Terms excludes refunds where a refund is required by applicable law.
24. Service Availability
We aim to provide Aethor reliably but cannot guarantee continuous and uninterrupted availability unless a specific service level has been expressly agreed.
Availability may temporarily be affected by:
- maintenance;
- security incidents;
- software updates;
- Discord outages;
- hosting-provider outages;
- API restrictions;
- network failures;
- events outside our reasonable control.
Mandatory statutory obligations relating to digital services remain unaffected.
25. Maintenance and Updates
Aethor may receive updates, bug fixes, security improvements and feature changes.
Necessary updates may be performed to maintain security, compatibility, legal compliance or contractual functionality.
Where consumer law requires updates or information concerning updates, those statutory obligations remain unaffected.
26. Changes to Aethor
We may modify Aethor where there is a valid reason for the change.
Valid reasons may include:
- security improvements;
- technical development;
- Discord API or platform changes;
- legal or regulatory requirements;
- prevention of abuse;
- changes required to maintain compatibility;
- improvements that do not materially disadvantage users.
Changes to continuously supplied digital services that materially impair a consumer's ability to access or use the service will be handled in accordance with applicable consumer law.
27. Beta and Experimental Features
Some functionality may be identified as beta, preview, experimental or otherwise under development.
Such functionality may contain errors, may change more frequently and may be removed before general release.
Any statutory rights that cannot legally be excluded remain unaffected.
28. Suspension and Restriction of Access
We may temporarily restrict access to Aethor where reasonably necessary to:
- protect Aethor or other users from security threats;
- prevent ongoing abuse;
- respond to attacks or excessive automated traffic;
- comply with legal obligations;
- comply with binding Discord platform requirements;
- investigate serious violations of these Terms.
Restrictions will be proportionate to the circumstances where reasonably possible.
29. Termination
Users may stop using Aethor at any time.
Server Administrators may remove Aethor from their Discord server through Discord.
Paid recurring services may be terminated in accordance with the cancellation conditions presented when the contract was concluded and applicable statutory law.
We may terminate or restrict a contractual relationship for good cause, including serious or repeated violations of these Terms, unlawful use, security threats or material abuse of the service.
Ordinary termination rights under applicable law or individually agreed contractual terms remain unaffected.
30. Data After Termination
Personal data will be handled in accordance with our Privacy Policy and applicable data protection law following termination or removal of Aethor.
Data that is no longer required for the applicable processing purpose will be deleted or anonymised unless continued retention is legally required or otherwise lawfully justified.
31. Privacy
Information concerning our processing of personal data is available in the Aethor Privacy Policy.
The Privacy Policy forms a separate privacy notice and does not reduce any rights granted under applicable data protection law.

32. No Sale of Discord API Data
Aethor does not sell Discord API data.
Discord API data will be used and shared only as permitted by Discord's applicable developer terms, applicable law and the purposes described in our Privacy Policy.
33. Warranty and Statutory Conformity Rights
Mandatory statutory warranty and conformity rights remain unaffected.
In particular, where Aethor constitutes a digital product or digital service within the meaning of applicable consumer law, consumers retain the mandatory rights provided by that law.
No statement in these Terms is intended to exclude statutory rights that cannot legally be excluded or restricted.
34. Liability
We are liable without limitation where damage results from intent or gross negligence.
We are also liable without limitation for damage resulting from injury to life, body or health where the statutory requirements for liability are met.
Liability under mandatory statutory provisions, including applicable product liability law, remains unaffected.
In cases of slight negligence, we are liable for breaches of essential contractual obligations whose fulfilment is necessary for proper performance of the contract and on whose compliance the contracting party may regularly rely.
In such cases of slight negligence, liability is limited to the damage that was typical and reasonably foreseeable at the time the contract was concluded, to the extent such limitation is permitted by law.
Liability for slight negligence is otherwise excluded to the extent legally permissible.
The above limitations also apply in favour of our legal representatives, employees and agents.
35. User Responsibility
Users are responsible for their own conduct when using Aethor.
Nothing in these Terms limits statutory claims arising from unlawful conduct by a user.
Users remain responsible for ensuring that content they submit, commands they execute and configurations they create do not violate applicable laws, third-party rights or Discord's rules.
36. Force Majeure and External Events
To the extent permitted by applicable law, delays or interruptions caused by events outside our reasonable control may temporarily affect Aethor.
Examples may include major network failures, infrastructure failures, natural disasters, large-scale cyberattacks, governmental measures or failures of essential third-party platforms.
Mandatory contractual and consumer rights remain unaffected.
37. Changes to These Terms
We may update these Terms where reasonably necessary due to:
- changes in applicable law;
- changes to Aethor's functionality;
- security requirements;
- changes to Discord's platform requirements;
- clarification of existing provisions;
- changes to our business or technical infrastructure.
Changes will not retroactively remove accrued statutory rights.
Where required by law or contract, users will be informed of material changes in advance.
Where consent to an amendment is legally required, the amendment will not become binding solely because the updated Terms were published.
38. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods, insofar as the exclusion is legally permissible.
If you are a consumer and have your habitual residence in another country, this choice of law does not deprive you of mandatory consumer protection provisions that would apply without this choice of law.
39. Jurisdiction
Statutory rules regarding jurisdiction apply to consumers.
Where the contracting party is a merchant, legal entity under public law or special fund under public law and a valid jurisdiction agreement is legally permissible, the competent courts at our place of business shall have jurisdiction.
40. Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board unless participation is required by applicable law.
41. Severability
If an individual provision of these Terms is or becomes invalid or unenforceable, the remaining provisions remain unaffected where legally permissible.
The invalid or unenforceable provision will be replaced by the applicable statutory provision rather than by a provision that improperly expands our contractual rights.
42. No Waiver
Failure to immediately enforce a contractual right does not by itself constitute a waiver of that right unless such waiver has been clearly declared or follows from applicable law.
